1. Purpose and scope

These general terms and conditions govern the contractual relationship between Grupo Empresarial Alme S.L. (hereinafter, the "Landlord"), owner of Apartamentos Villa Torcal, and the customer (hereinafter, the "Guest") arising from the booking and use of the holiday apartments offered. Making a booking implies full and unreserved acceptance of these terms and conditions.

2. Booking and confirmation

Bookings may be made through the official channels provided (website, telephone or authorised distribution platforms). A booking will be confirmed only when the Landlord issues a written confirmation and, where applicable, the required payment has been made. The Guest must provide true and complete information during the booking process.

3. Prices and payment

Published prices include the applicable VAT and are per apartment per night, unless otherwise stated. The Landlord reserves the right to change prices at any time, without this affecting bookings that have already been confirmed. Payment may be made by credit/debit card, bank transfer or other methods indicated during the booking process. In the event of non-payment, the Landlord may cancel the booking.

4. Cancellation policy

The customer may cancel the booking free of charge up to 2 days before the arrival date.

The customer will have to pay the price of the first night if they cancel within the 2 days before the arrival date.

If the customer does not show up, they will have to pay the full price of the booking.

Cancellations must be notified in writing by email or through the official booking channel. The effective cancellation date will be the date on which the notification is received.

5. Check-in and check-out

Check-in time is from 14:00. Check-out time is before 11:00. Arrival is self check-in by means of a code and may take place at any time from check-in time onwards. Before arrival, all guests must complete the guest registration required by law with a valid identity document (Spanish ID (DNI/NIE) or passport); access instructions are sent once the registration has been completed. Check-in before 14:00 or check-out after 11:00 is subject to availability and must be requested in advance.

6. Number of occupants and use of the apartment

The maximum number of occupants per apartment is that stated in the accommodation description. Accommodating more people than those booked is not permitted. The apartment shall be used exclusively for tourist accommodation purposes and may not be used for parties, events or commercial activities. Smoking inside the apartments is prohibited.

7. Security deposit

No security deposit is charged. The Guest is liable for any damage caused to the apartment or its facilities during the stay, and the cost of repair or replacement will be invoiced to them.

8. Liability

The Landlord accepts no liability for personal injury or material damage that the Guest or their companions may suffer as a result of improper use of the facilities. The Guest shall be liable for any damage or breakage caused to the apartment during their stay. The Landlord accepts no liability for the theft or loss of the Guest's personal belongings.

9. Pets

Pets are not allowed.

10. Data protection

Personal data provided by the Guest will be processed in accordance with the Data Privacy Statement of Apartamentos Villa Torcal and with the data protection legislation in force (GDPR and LOPDGDD). The data will be used exclusively for managing the booking and the contractual relationship.

11. Applicable law and dispute resolution

These terms and conditions are governed by Spanish law. For the resolution of any dispute, the parties submit to the Courts and Tribunals of Málaga, expressly waiving any other jurisdiction to which they might be entitled.

12. Amendments

The Landlord reserves the right to amend these general terms and conditions at any time. Amendments will apply to bookings made after their publication.
